In Swiss employment references, omitting standard closing expressions of regret creates eloquent silence ('beredtes Schweigen'). While prospective employers interpret this omission negatively, Swiss courts have ruled that there is no enforceable legal entitlement to expressions of thanks, regret, or good wishes (BGer 4C.36/2004; BVGer A-364/2022). Therefore, an amendment can be requested from the employer, but it cannot be enforced through litigation.

The Administrative Court of the Canton of Zurich describes the practice of “telling silence” (beredtes Schweigen): if a quality that would normally be mentioned is left out, the reader concludes that it is missing. Leaving out one group of people when describing conduct (e.g. superiors) is generally read as a hint at negative behaviour.
