What it means in detail

Under art. 330a CO and the principle of goodwill, Swiss HR uses specific coded phrasing for interpersonal issues. Calling someone "sociable" rather than praising professional conduct hints at disruptive behavior or workplace drinking. A formal written request should be submitted to correct the phrasing.

The Administrative Court of the Canton of Zurich describes the practice of “telling silence” (beredtes Schweigen): if a quality that would normally be mentioned is left out, the reader concludes that it is missing. Leaving out one group of people when describing conduct (e.g. superiors) is generally read as a hint at negative behaviour.
