What it means in detail

Under Swiss employment law (art. 330a CO), the principle of goodwill leads employers to omit expected statements when performance was unsatisfactory. If a standard evaluation of social conduct is missing, Swiss HR professionals assume the employee lacked those qualities (Verwaltungsgericht ZH VB.2019.00365). A complete full reference ('Vollzeugnis') must comment on both performance and conduct (art. 330a CO; BGE 129 III 177).

Telling silence & social conduct

Verwaltungsgericht ZH VB.2019.00365 vom 9. Mai 2020, E. 2.4

The Administrative Court of the Canton of Zurich describes the practice of “telling silence” (beredtes Schweigen): if a quality that would normally be mentioned is left out, the reader concludes that it is missing. Leaving out one group of people when describing conduct (e.g. superiors) is generally read as a hint at negative behaviour.
